Who is eligible?
  1. Individuals dependent on or addicted to drugs, alcohol or other controlled substance.
  2. Individuals committed to recovery.
  3. Individuals willing and able to attend one or more daily scheduled treatment activities.
  4. Individuals with a non violent criminal history.
  5. Individuals with pending criminal charges.
  6. Individuals who are mentally and physically able to fulfill the program requirements.
Court referral to enter drug court?
The Solicitor must refer the interested defendant to Drug Court.

Horry County Drug Court: Level I

Horry County Drug Court Level I is a judicially supervised treatment program that requires a minimum of nine months to complete. The client must have pending non violent criminal charges. If accepted into Drug Court, the client will plead guilty to the pending charge(s) and will be sentenced. The sentence will be suspended upon completion of Drug Court. If the client does not complete Drug Court, he/she will be immediately remanded to the Department of Corrections to serve the sentence. While in Drug Court, the client will be required to attend two treatment sessions each week, three self help meetings each week, a monthly court appearance to the Drug Court Judge, and submit to random drug, alcohol, and hair testing. In order to complete Drug Court, the client will be required to comply with all program requirements and have no positive alcohol or drug screens for a minimum of 210 consecutive days.

Horry County Drug Court: Level II

Horry County Drug Court Level II is a judicially supervised drug treatment program that requires a minimum of eighteen months to complete. The client must have pending criminal charges. If accepted into Drug Court, the client will plead guilty to the pending charge(s) and will be sentenced. The sentence will be suspended upon completion of Drug Court. If the client does not complete Drug Court, he/she will be immediately remanded to the Department of Corrections to serve the sentence. While in Drug Court, the client will be required to attend three treatment sessions each week, four self help meetings each week, a weekly court appearance to the Drug Court Judge and submit to random drug, alcohol, and hair testing. In order to complete Drug Court, the client will be required to comply with all program requirements and have no positive alcohol or drug screens for 365 consecutive days.

Georgetown Drug Court

Georgetown County Drug Court is a judicially supervised drug treatment program that requires a minimum of twelve months to complete. The client must have pending criminal charges. If accepted into Drug Court, the client will plead guilty to the pending charge(s) and will be sentenced. The sentence will be suspended upon completion of Drug Court. If the client does not complete Drug Court, he/she will be immediately remanded to the Department of Corrections to serve the sentence. While in Drug Court, the client will be required to attend two treatment sessions each week, four self help meetings each week, a weekly court appearance to the Drug Court Judge and submit to random drug, alcohol, and hair testing. In order to complete Drug Court, the client will be required to comply with all program requirements and have no positive alcohol or drug screens for 270 consecutive days.

Successful Completion

Upon successful completion of Drug Court, the sentence will be satisfied. Also, the plea will be reopened and the Drug Court charges will be dismissed.

Unsuccessful Completion

Upon unsuccessful completion, the Drug Court Judge will impose the original sentence. The client will be immediately remanded to the Department of Corrections.
