Amendment to the Code of Law
(Regarding Public Records)
'A person preparing or filing a document for recordation or filing in the official records may not include a social security, driver's license, state identification, passport, checking account, savings account, credit card, or debit card number, or personal identification (PIN) code, or passwords in the document, unless expressly required by law.
An individual has a right to request a register of deeds or clerk of court to remove, from an image or copy of an official record placed on a publicly available
Internet web site or on a publicly available Internet web site used by a register of deeds or clerk of court to display public records,
any social security, driver's license, state identification, passport, checking account, savings account, credit card, or debit card number, or personal identification (PIN) code, or passwords contained in an official record.
The request must be made in writing and delivered by mail, facsimile, or electronic transmission or in person, to the register of deeds or clerk of court. The request must specify the identification page number that contains the social security, driver's license, state identification, passport, checking account, savings account, credit card, debit card number, or personal identification (PIN) code, or passwords to be redacted. There is no fee for the redaction pursuant to request.'

- How can I obtain a copy of an instrument of record?
Make a request in writing as to which instrument you require a copy of, providing
information for the location of the instrument, along with a check or money order in the
amount of $8.00 per instrument for 1-4 pages. Each additional page is $1.00. A payment of
$10.00 for a copy of a Plat is required. Certification of the document is an additional
fee of $2.00.

- What is the cost of recording a particular instrument?
There are many different fees on our price list. The most common fee is for recording a
Deed, which is $10.00 for the first four pages and $1.00 for each page there after. There
is also a Tax Stamp fee of $3.70 per thousand of the sales price if the Deed is not exempt.

- What land is in my name?
The Register of Deed’s staff members are not authorized to provide any record searches. The
Legal Ethics Rules concerning the unauthorized practice of law as stated in section 11.2.1.1
gives directions as to who may research records.
- Affidavit: A written statement sworn to before a person officially permitted by law to
administer an oath.
- Acknowledgement Statement: A statement by a Notary Public stating that the grantor personally
appeared before them and acknowledged an execution of a document. The Notary Public may also be one
of the witnesses.
- Conveyance: A transfer of title.
- Derivation Clause: A written statement in the property description that includes the name of
the grantor and the recording date of that deed.
- Financing Statement: Instrument filed in accordance to the Uniform Commercial Code showing
a lien filed on real property with the County or collateral goods filed with the State. You may obtain
copies of the new UCC forms by linking to www.scsos.com/forms.htm.
- Mechanics Lien: A workman's legal claim to hold property worked on (or at least to file formal
papers securing a right to property) until the charges are paid.
- Probate Statement: A statement by a Notary Public stating that a witness appeared before them
stating that they witnessed the personal execution of a document by a grantor.
- U.C.C.: Uniform Commercial code. A comprehensive set of laws on every major type of business law.
- Upgrade in computerization of the Recording Desk to reflect the reproduction of a label
to be attached to the instrument with the recording information.
- Scanning of the recorded instruments by Register of Deeds staff members, releasing the
original instrument to the filer more rapidly.
- To provide the public with access to the land record induces and images via the website.
