eRecording

Horry County now offers the ability to electronically record land records. This service will allow real estate professionals (lawyers, bankers, commercial lenders, etc) to record land documents electronically. This process can save the customer both time and money as they will be able to record land documents safely and securely from the comfort of their offices. Please follow the Horry County Register of Deeds guidelines below should you be interested in eRecording in the future.

  • Must utilize an electronic recording delivery system (vendor) approved by the County. At present the following two vendors exist to choose from:

  • County transmittal requirements:
    state definition in Chapter 113, Section 325 of SC Code of Regulations
    • Document Type – state definition in Chapter 113, Section 325 of SC Code of Regulations
    • Date of Instrument - date the document was executed
    • Return to – each transmittal cover sheet shall have a return to name, address, phone number, fax number and email address
    • Related Documents – book/page numbers of any related documents pertaining to the submitted document, not the derivation clause book/page.
    • Purchase Price/Mortgage Amount – amount that was paid on the document
    • Brief Property Description – very brief legal description of property. Unit, lot, block, subdivision, city, etc. Not the entire legal description as written on the document.
    • Tax Map #/PIN # - if known ahead of time please place on transmittal
    • Party Names – Be sure to enter all party names that need to be indexed. This includes the grantor's name, the grantee's name and the full name of business.
      Please enter names in the following order: LAST FIRST MIDDLE SUFFIX
      The FULL name of business should be bolded, underlined or capitalized in a way to stand out for indexing.
      Example Grantor or Grantee name: Smith John Doe Jr
      Example Business name: SMITH TOOLS INC
      Do not use any punctuation.

    PLEASE NOTE: The transmittal sheet becomes the first page of the filed instrument. The transmittal sheet book and page number must be utilized for future recordings related to the filed instrument (satisfactions, partial releases, assignments, etc).
  • Must follow normal County pre-requisites for recording instruments.

Escrow Accounts

View Images Online

We are pleased to announce an new service enhancement to our OnCore Online Public Search. Users can now view, print, and save documents online for a fee ($.50 per page). This service is currently available for Escrow Account holders ONLY.

  • If you currently have an Escrow Account and would require this functionality please contact the ROD office so that a staff member may assist in updating your account.
  • If you currently do not have an Escrow Account you may open one by either coming directly to the office, or sending in a written request by mail with a $25.00 check for deposit into your account with the following information:
    • Name of account
    • Address
    • Phone # + name of contact person
    • Email address
    • Password you would like for the account. This is case sensitive.

Account Activity

The Register of Deeds understands that Law Firms may want to keep a recording account separate from a copy account. At this time we have no issues with having separate copy & recording accounts, however, we do not intend to create multiple copy accounts for the same office. Each escrow account has the ability to have multiple users utilizing the account at the same time. It will be the responsibility of the Law Firm/Abstractor to ensure that the account has enough money to cover multiple users.

You may request a copy of your Escrow Account Activity at any time either by walking into the office, or sending a written request by mail. The fee associated with the request will be $1.00 per page. We have the ability to print this report for any date range that you specify.

Common Terms

  • Affidavit: A written statement sworn to before a person officially permitted by law to administer an oath.

  • Acknowledgement Statement: A statement by a Notary Public stating that the grantor personally appeared before them and acknowledged an execution of a document. The Notary Public may also be one of the witnesses.

  • Conveyance: A transfer of title.

  • Derivation Clause: A written statement in the property description that includes the name of the grantor and the recording date of that deed.

  • Financing Statement: Instrument filed in accordance to the Uniform Commercial Code showing a lien filed on real property with the County or collateral goods filed with the State. You may obtain copies of the new UCC forms by linking to www.scsos.com/forms.htm.

  • Mechanics Lien: A workman's legal claim to hold property worked on (or at least to file formal papers securing a right to property) until the charges are paid.

  • Probate Statement: A statement by a Notary Public stating that a witness appeared before them stating that they witnessed the personal execution of a document by a grantor.

  • U.C.C.: Uniform Commercial code. A comprehensive set of laws on every major type of business law.

Major Projects

  • Upgrade in computerization of the Recording Desk to reflect the reproduction of a label to be attached to the instrument with the recording information.

  • Scanning of the recorded instruments by Register of Deeds staff members, releasing the original instrument to the filer more rapidly.

  • To provide the public with access to the land record indexes and images via the website.

  • Back scanning images in the deed books from 1984 through 1995.

  • Back scanning tax lien images from 1998 through 2006

Interesting Facts

  • Instruments recorded in the Deed, Mortgage, Lien and Plat books are imaged and available to the public for viewing immediately on the premises. The indexes may be accessed via the internet. The data is current as of the previous day's close of business. Images are not currently available on the internet.

  • Revised Uniform Commercial Codes Starting July 1, 2001
