Field Operations

Common Pleas

The Sheriff is mandated by South Carolina law to serve the process of the court. The Horry County Sheriff's Office takes this responsibility very seriously and takes pride in the service our deputies provide. The Sheriff's Office serves all civil court papers for Horry County received from any court of record to include all Magistrate Courts, Common Pleas, Master-in-Equity, and Family Court. The Horry County Sheriff’s Office processes and serves between 35,000 to 40,000 papers each year. Deputies serving Civil Process papers are uniformed and easily identified. Private process servers are not employed by the Horry County Sheriff's Office and drive unmarked vehicles. If you have new information regarding a family court paper, contact Administrative Assistant Kim Costa by phone at 843-915-8574. Please include the defendant’s name, case number and court date in your message.

Magistrate Process

If you have filed an Eviction Notice with the Magistrate's Court, please take note that a tenant must either be personally served or the eviction notice must be posted on the property on two (2) separate occasions. Please wait at least five days after you have filed your paperwork with the Magistrate’s Office before contacting the Sheriff’s Office about the service of your papers.

If you have filed and were awarded a 24-hour Writ of Ejectment, then the deputy will serve the Writ as soon as possible. If the tenant has not left after the 24-hour notice has been served or posted, you must contact the Sheriff’s Office for assistance in removing your tenant. You may not enter the premises and remove personal property without a Deputy Sheriff. The landlord will be required to move all of the tenant’s personal property to the curb for a period of at least 48 hours. Please make sure that if you require a deputy’s assistance, then the landlord must have the manpower and means necessary to remove all tenants’ personal property. The Sheriff’s Office conducts Sheriff Sales on personal property and real property to satisfy judgments. Information regarding the sale will be posted on our website, as well as in the Horry County Government and Judicial Center and the local newspaper.

Judicial Sales ordered by the Magistrate are conducted on the first Monday of each month at 10:00 a.m. If the first Monday is a holiday, the sale will be held the following Tuesday. Check your local Magistrate's Office for all judicial sale notices. If you have any questions about a judicial sale, contact Sgt. Benton at (843) 915-8578.
